1. Overview
Welcome to Pokémon TCG Canada.
These Terms of Service ("Terms") govern your use of our website, online store, products, content and related services (collectively, the "Services").
Throughout these Terms, "Pokémon TCG Canada," "we," "us" and "our" refer to Pokémon TCG Canada.
By accessing our website, placing an order or otherwise using the Services, you agree to these Terms and to any policies incorporated into them, including our Privacy Policy, Refund Policy and Shipping Policy.
If you do not agree with these Terms, you should not use the Services.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded or limited under applicable consumer protection law.
2. Eligibility and Account Information
You must be at least the age of majority in your province or territory of residence to make purchases through the Services, or have the permission and supervision of a parent or legal guardian.
When placing an order or creating an account, you agree to provide accurate, current and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
We may refuse, suspend or terminate access to an account where we reasonably believe it is being used fraudulently, unlawfully or in violation of these Terms.
3. Products and Product Information
We make reasonable efforts to accurately describe and display the products available through our store.
Product photographs, colours and appearance may vary depending on lighting, photography, manufacturing variations, your display and other factors.
Unless otherwise stated, product availability is not guaranteed until an order has been accepted and fulfilled.
We may change product descriptions, prices, quantities or availability at any time.
We may also establish purchase limits for limited-stock or high-demand products. These limits may apply per customer, household, shipping address, billing address, payment method or other reasonable identifying information.
Orders placed in an attempt to circumvent clearly disclosed purchase limits may be cancelled.
4. Trading Cards and Collectible Products
Singles
Individual trading cards are sold according to the condition, language, set, card number, finish and other characteristics stated in the applicable product listing.
Card condition assessments involve some degree of judgment and are not a guarantee that a third-party grading company will assign any particular grade.
Unless a listing specifically states that the photograph is of the exact card being purchased, product photographs may be representative.
Manufacturing characteristics such as centering, print lines, print dots, surface characteristics, factory cutting and other normal production variations may occur even on otherwise high-condition cards.
Sealed Products
Sealed products may have minor cosmetic imperfections resulting from manufacturing, shipping, storage or normal handling, including small dents, scratches, loose wrapping or similar packaging imperfections.
Unless specifically advertised as such, sealed products are not guaranteed to be "display grade," investment grade or free from minor packaging imperfections.
Collectible Value
We do not guarantee the future value, resale value, market price, rarity or third-party grading result of any collectible product.
5. Orders
Submitting an order constitutes an offer to purchase the products in your cart.
An automated order confirmation confirms that we received your order. It does not prevent us from cancelling or modifying an order where reasonably necessary, including because of:

inventory discrepancies;

pricing or listing errors;

payment authorization issues;
-
suspected fraud;
-
violation or circumvention of purchase limits;

shipping restrictions; or
-
circumstances that make fulfillment impossible or commercially unreasonable.
If we cancel an item that you have already paid for, we will refund the applicable amount to your original payment method.
Please review your order carefully before submitting it. Cancellation requests are handled according to our Refund Policy and applicable law and may not be possible once an order has entered processing or has shipped.
6. Preorders
Products identified as preorders are products that are not yet available for immediate shipment.
Release dates and expected arrival dates are estimates unless expressly stated otherwise. Manufacturer, distributor, carrier or other delays may cause release or fulfillment dates to change.
Preorder inventory may also be subject to distributor or manufacturer allocation.
Unless the applicable product listing states otherwise, payment for a preorder may be collected when the order is placed.
If we are unable to fulfill a preorder, we may cancel the affected item and issue a refund to the original payment method.
A change to an estimated release or arrival date does not automatically cancel an order. Preorder cancellation requests are subject to our Refund Policy and any rights provided by applicable law.
Where an order contains both in-stock and preorder products, fulfillment will be handled according to the product listing and our Shipping Policy.
7. Pricing, Taxes and Payment
Unless otherwise stated, prices displayed by Pokémon TCG Canada are in Canadian dollars (CAD).
Applicable taxes and shipping charges are calculated or disclosed during checkout.
Prices, discounts and promotions may change without notice. The price applicable to an order is generally the price displayed when the order is placed, subject to correction of genuine errors and applicable law.
We reserve the right to correct genuine typographical, technical, inventory or pricing errors.
If an error materially affects an order that has already been submitted, we may contact you, cancel the affected item or order and refund any applicable payment.
Promotional codes, discounts and special offers may have separate conditions, restrictions or expiry dates.
You represent that you are authorized to use the payment method provided for your purchase.
8. Shipping and Delivery
We ship to destinations and using shipping methods made available through checkout.
You are responsible for providing a complete and accurate shipping address.
Shipping and delivery dates are estimates unless expressly guaranteed. Carrier delays, weather, service disruptions and other circumstances outside our reasonable control may affect delivery times.
Some shipping options may not include tracking or delivery confirmation. If you select an untracked shipping method, tracking events, delivery scans and carrier delivery confirmation will not be available.
Lost, damaged, delayed or returned shipments are handled according to our Shipping Policy, Refund Policy and applicable law.
If an order is returned to us because of an incorrect or incomplete address, refusal, failure to claim the shipment or another circumstance attributable to the recipient, additional shipping charges may apply before the order is resent, to the extent permitted by applicable law.
9. Returns, Refunds and Exchanges
Returns, refunds, exchanges, cancellations and damaged or incorrect orders are governed by our Refund Policy:

Nothing in our Refund Policy or these Terms limits any return, refund, cancellation, warranty or other right that you are entitled to under applicable law.
10. Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy:
Because our store is hosted by Shopify, certain information is also processed by Shopify and its service providers in order to operate the store, process transactions and provide related services.
11. Intellectual Property
The original content and design of the Pokémon TCG Canada website, including original text, graphics, branding, layout, software and other materials created by or for us, are owned by us or used with permission and may be protected by applicable intellectual property laws.
You may use the website for personal, non-commercial purposes. You may not reproduce, republish, distribute, commercially exploit or systematically extract our original website content without permission.
Trading card artwork, product names, character names, logos, trademarks and other intellectual property belonging to third parties remain the property of their respective owners.
Pokémon TCG Canada is an independently operated retailer and is not affiliated with, sponsored by or endorsed by The Pokémon Company International or other third-party rights holders unless expressly stated otherwise.
12. Prohibited Uses
You may not use the Services:

for an unlawful or fraudulent purpose;

to violate the rights of another person;

to provide false or misleading information;

to introduce malware, malicious code or harmful technology;

to interfere with or disrupt the security or operation of the website;

to impersonate another person or entity;

to obtain unauthorized access to accounts, systems or data;

to circumvent technical restrictions or purchase limits;

to use automated systems in a manner that materially disrupts the Services or provides unauthorized access; or

to scrape, reproduce or commercially exploit substantial portions of our website or data without permission.
We may restrict or terminate access where we reasonably believe these Terms have been violated.
13. Third-Party Services and Links
Our Services may contain links to or integrations with third-party websites, payment providers, shipping carriers, applications or other services.
Third-party services are governed by their own terms and policies.
We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot legally be excluded.
14. Shopify
Pokémon TCG Canada is powered by Shopify, which provides the ecommerce platform used to operate our online store.
Purchases made through our store are transactions between you and Pokémon TCG Canada, not between you and Shopify.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for products sold by Pokémon TCG Canada or for claims arising solely from transactions between you and Pokémon TCG Canada.
Your use of certain Shopify-provided functionality may also be subject to Shopify's applicable terms and privacy policies.
15. Errors and Availability
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, product quantities, availability, shipping charges or estimated delivery times.
We may correct these errors and update information when discovered.
Products displayed as available may become unavailable before inventory systems are updated. This is especially possible with limited-stock products, collectible products and high-demand releases.
Where we cannot fulfill a paid order, we will provide an appropriate refund for the unfulfilled portion.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and Services are provided on an "as available" basis.
We do not guarantee that the website will always be uninterrupted, secure or error-free.
Except for warranties, conditions, representations and rights that cannot legally be excluded, we disclaim implied warranties and conditions to the fullest extent permitted by law.
Nothing in this section excludes or limits any statutory warranty or consumer protection that applies to your purchase.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Pokémon TCG Canada and its owners, employees, contractors, service providers and affiliates will not be liable for indirect, incidental, special, punitive or consequential damages arising from your use of the Services or purchase of products.
Where liability cannot legally be excluded, this provision applies only to the maximum extent permitted by applicable law.
Nothing in these Terms excludes liability or remedies that cannot legally be excluded or restricted.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Pokémon TCG Canada harmless from third-party claims, losses or reasonable costs resulting from your unlawful use of the Services, your intentional violation of these Terms or your infringement of another person's rights.
This section does not require you to indemnify us for our own negligence, unlawful conduct or responsibilities that cannot legally be transferred to you.
19. Severability
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or severed only to the extent necessary.
The remaining provisions will continue in effect.
20. No Waiver
Our failure to enforce any provision of these Terms on one occasion does not waive our right to enforce that provision later.
21. Entire Agreement
These Terms, together with policies and terms specifically incorporated into them, constitute the agreement governing your use of the Services and purchases from Pokémon TCG Canada.
If there is a conflict between these Terms and a specific product promotion, preorder condition or other expressly stated term, the more specific term will apply to the extent of the conflict, subject to applicable law.
22. Governing Law
These Terms and purchases made through Pokémon TCG Canada are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any rights you may have under applicable consumer protection law, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of New Brunswick.
Nothing in this section prevents a consumer from exercising a right or remedy available under mandatory consumer protection legislation.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.
The current version will be posted on this page with an updated effective date.
Changes will apply prospectively unless applicable law requires otherwise.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
